The information below will help you understand what evidence is required for an asbestos claim and the legal rights you have in a situation such as this under personal injury law.

What is Asbestos?

Asbestos is a dangerous material that was previously used as a form of insulation in the construction industry. It was used to insulate homes and buildings from drafts and cold air seeping into the structure. However, it was later found that asbestos also caused lung disease in the workers who installed the material into a home or building. Even though it is now illegal to install asbestos in buildings, if you have been living in an old apartment, more than likely asbestos was used as the insulation. Your landlord should be doing health and safety checks, but it can be that after your apartment building undergoes repair work, the presence of asbestos is made.

The Health Effects of Asbestos

The problem with asbestos is this substance enters the cells of the lungs and wreaks havoc. The person can suffer problems breathing after the inhalation of asbestos.

When inhaled into the lungs, asbestos can cause the condition known as asbestosis. It involves cysts replacing the normal structure of the lungs. Someone can also develop chronic lung conditions such as asthma or become more prone to lung infections leading to bronchitis.

Another main problem with asbestos is that it causes more severe lung conditions such as lung cancer. This lung cancer is called mesothelioma. This is a rare type of cancer that many of the asbestos installers died of, as it is many associated with those who inhaled asbestos dust.  This is the first thing condition that triggered the notion that asbestos could be dangerous to human health, and this led to the government stating that it had to be removed from houses and apartment buildings.

Other than installers of asbestos, other occupations at risk include shipyard and boating workers, teachers, and factory workers.
