There is no in hard rock standard for arriving at the settlement dollars in any given case. The controlling factors are;

1) the nature of the injury and its physical permanency,

2) the quality of the case as far as establishing liability,

3) the experience of the attorney that you retain and most importantly

4) the insurance company you are dealing with.

Insurance companies and their agents either want to quickly resolve the dispute at a small amount or are willing to battle to the end. (sometimes to the courthouse steps settlement)

In this regard it is important from the very beginning to put together a solid case and have that fact comfortably conveyed to the insurer.

NOTE Defense attorneys make their monies by fighting the matter. If they settle early they don’t make the amount of $ they want. In this regard there is a balancing act between them wanting big legal service defense $’s and their realizing that if they lose the case they might lose the insurance company as their clients.
