Do You Need a Lawyer To Write a Demand Letter?

When faced with writing a demand letter to insurance companies, many accident or injury victims are at a loss on how to proceed. In other cases, the victim may feel they are required to use legal counsel to construct a demand letter. In essence, a demand letter does not require legal counsel, but many victims will benefit from the assistance of a lawyer, especially those involving claims with relatively large damages or prolonged injuries.

When Legal Counsel Might Not Be Necessary

Not all claims require a demand letter. In fact, the claims process has become relative uniform, especially for those claims involving minor injuries. For relatively minor claims with minor damages, a claimant (victim) may be better served by not using legal counsel. For instance, a car accident victim who has suffered no injuries as the result of a crash, but did incur medical costs for seeking a medical evaluation, might be better served by writing their own demand letter. In other cases, by the time a victim starts a demand letter, the extent of their injuries and other damages may have already passed, which ultimately does not require them to demand compensation for unpredictable future damages.

The reasoning behind not seeking legal counsel is a practical consideration. Using an attorney will cost the victim money (especially is a lawyer is working on a contingency basis). Claims involving minor damages or low demand amounts may be better served by negotiating the claim oneself. In addition, the claims process is often through an insurance company that handles thousands of similar claims annually, and in reality, certain cases simply do not present much room for negotiated settlements should legal counsel be used.

When Legal Counsel Will Be Useful, if Not Essential

In claims cases where liability is not certain, using a lawyer may prove helpful to ensure a claimant’s right to recover damages. In other cases, a claimant may experience grievous injuries and relatively large special damages, as well as general damages. Using a lawyer may prove beneficial in these cases. Furthermore, claims involving damages to account for future injuries and damages also will benefit from the intervention of a lawyer, who can assist victims in ensuring they receive a settlement amount that accounts for past, current, and future losses as the result of an accident or injury.

One of the most notable reasons to use legal counsel would be if it appears that an injury claim will be contested by an insurance company, or if the insurance company fails to offer a reasonable settlement amount in the eyes of the claimant. At this point, the use of legal counsel may promote the favorable outcome an injury victim originally desired.

Getting Legal Help with Writing a Demand Letter

The need to retain a lawyer to write a demand letter is an entirely personal decision. However, many lawyers offer a free initial consultation with victims, which might be in the best interest of a victim to attend one or two to learn more about their legal options. Not only can a lawyer help create a demand letter for an injury victim, but just as importantly, the lawyer can also engage in the ensuing negotiations with an insurance company over compensation amounts on behalf of an injury victim.
