Client's often ask me why there case has not settled and why the insurance company wants to go to court. The answer is somewhat complicated. There are a number of factors that go into insurance company claims and settlement evaluation. They look at the history of the plaintiff; does the victim have prior injuries; how old is the plaintiff. how did the accident happen; what jurisdiction will the case be tried; is there economic loss to the plaintiff; what is the injury and who will be the expert called upon to prove the injury.
Insurance Companies Try to Pay as Little as Possible
The bottom line is that the insurance company is looking to pay the least possible and if they do not agree to fairly and adequately compensate the plaintiff, the case must be evaluated by a jury. Since most courts have a waiting list for a judge and jury, the plaintiff must be patient. Eventually your turn will come. With the right lawyer, you will be properly prepared for trial.
