When you suffer a head injury, a concussion is a common result. A person's brain is sensitive and is surrounded by hard bones in the skull. Normally, a fluid called spinal fluid helps to protect your head from damage and to keep you safe. However, if the impact of a blow to the head is too hard, the spinal fluid won't be able to help and you could- in a sense- hit your brain too hard... which can result in bruising and/or concussion. In most cases, concussions are treatable and go away quickly. In fact, you are usually just observed for a bit to see if complications arise. Sometimes, however, a concussion doesn't just go away and more serious problems can develop that require treatment. If this occurs, you'll need to understand when concussion treatment is reimbursed and how much of it is reimbursed.

Getting Payment for Concussion Treatment

Whether and how much payment you can get to reimburse you for concussion treatment depends heavily on the situation:

  • If you live in a no fault state and you get into a car accident, all of your medical costs are usually reimbursed through your personal injury protection (PIP) regardless of who is at fault for the accident- but different states have slightly different rules so you'll need to check your state law
  • If you live in a fault state and get into a car accident, you should be able to be reimbursed 100 percent from the responsible driver's insurer. Of course, if they offer you less and you decide to settle, then that is your choice and you won't be able to sue for more
  • If you get into any type of accident and have to sue, you'll have to win your case. If you do win, the jury will usually award you 100 percent of your medical bills as part of your damages
