I ate seafood at a restaurant that gave me really bad poisoning. Can I file a personal injury claim against the restaurant?

I went to a restaurant a month ago and ate some unsafe seafood. I suffered from food poisoning and had to have my stomach pumped. This was expensive and extremely painful. Does the restaurant have any liability for my medical injuries and can I sue them?

If you are able to prove that the restaurant served you unsafe food, then the restaurant may be liable to you for your medical injuries and possibly for pain and suffering that you incurred as a result. Restaurants have a duty of care to their patrons and if they served food that was unsafe or contaminated or in some way made patrons ill, this is a breach of that legal duty. You should consult with an experienced personal injury attorney in your area that can help you determine the restaurants liability. You should also keep records of all of you medical injuries and costs and any other evidence you have that the unsafe seafood was the cause of the injuries that you sustained.
