I got into an accident while Skiing because there was a lot of debree in the snow. Is the ski resort liable for being negligent?

Recently, I was in a ski accident. Debree on mountain caused the accident I think. There were abandoned ski poles and skis on the mountain covered in snow. They looked as if they had been there for a while and no one had picked them up, and they were partially covered so I didn’t see them. My skis caught on the debree and I fell and shattered my knee cap. Can I sue the ski resort for the ski accident, debree on mountain or any other negligence on their part?

A ski resort has a duty to maintain the slopes in a reasonably safe condition. If the poles and skis on the mountain had been lying there for a long period of time, the ski resort may have breached their duty of reasonable care in maintaining a safe environment for skiers. Since you were on the land for a commercial purpose and you likely paid for a ticket, you will likely be classified as an “invitee” under the law and thus the ski resort owes you a high duty of care and may be held legally liable for that breach. You should contact an experienced personal injury attorney who can help you determine whether the ski resort breached their reasonable duty of care by allowing the debris to remain on the ski slopes, leading to your injury.
