Can I still file a compensation claim for carpal tunnel injury?

I was part of a company wide downsizing.  A month before I got laid off, I had gone to a doctor and he said I had symptoms of carpel tunnel syndrome. Can I still file for workers compensation?

Answers

Workers compensation is a benefit system designed to help workers who have become injured or sick due to their work conditions or environment. The time limit to file claims varies depending on the state you reside it and in many cases it may still be possible to file for workers compensation for an on the job injury after you have been laid off.  Please refer to your state's Department of Labor to find out more about the time you have to file.

If you have not already done so, you should notify your employer as soon as possible.  In addition, you may also contact your former employer's insurance carrier directly.  Typically, this information is displayed in a common area at your workplace.  After notification, you must fill out the appropriate paperwork to file your claim.  In general, the procedure is to fill out an employer's first report of occupational injury form and submit it to your state's Department of Labor office.  Given the importance of the form, it may be advisable to seek help from a workers compensation or personal injury lawyer.
