Home construction defect caused injury. Who is liable for the damages?

I had a custom home built with contractors on land I bought in a small suburb. A month after I moved in, there was a defect on the deck of my patio which caused me to trip and fall. I was badly injured, out of work, and ended up with medical bills beyond what I am covered under. Can I sue?

Property defects are covered under premise liability law and since the home was recently constructed, the contractors do bear some liability in building a home free of defects and generally safe. You should contact your construction company and inform them of what has happened. You should also talk to a personal injury attorney immediately.

You should be able to recover for a full breadth of damages and also get a court order for the contractors to repair your home. Since this defect has arisen, you should question the overall quality and craftsmanship of the remainder of your home and have an expert inspect it. This expense can also be held liable by the contractors with a successful claim.
