An orthodontist, as any other physician, is subject to professional liability for failure to diagnose, improper care or treatment, failure to obtain informed consent, or other forms of negligence.  The orthodontist would be liable for negligence is he failed to meet a standard of reasonable medical care, and that the service he provided was negligent and substandard.  To prove negligence, a plaintiff must show that the orthodontist owed him or her a duty and breached the duty, as well as that the physician's breach of the duty resulted in an injury and was the proximate cause of the latter.  Courts define 'proximate cause' as one that in continuous sequence, not cut off by an independent cause, produces the injury alleged and without which the injury would not have taken place.
