Will homeowners insurance cover an injury lawsuit brought by a neighbor injured on my property?

Homeowners insurance has two different types of coverage for injuries to another, medical payments coverage and liability coverage. Encompassed in these are injuries on your property or injuries caused by you or even your pet outside your home or land. The two coverages, although similar, afford coverage for different types of circumstances. For example, if there were a suit by a neighbor, that would most likely be covered and defended under the liability portion. 

Liability coverage is available under a homeowners policy for injuries which you are liable for. Liability coverage usually starts around $100,000. If a neighbor falls on your property due to your negligence, this coverage will be available to handle medical bills and pain and suffering the injury has caused. Liability has to be clear in order for this coverage to be afforded, if there was no negligence by you or a family member then the coverage would be afforded under medical payments coverage. 

Medical payments coverage handles only medical bills accumulated due to the injury, and does not compensate for pain and suffering. This type of coverage is afforded if there were an injury by a visitor that was not due to the negligence of you or a family member. This coverage is usually around $1,000 to $25,000. 

In the event of a suit by a neighbor, your homeowners policy would provide a defense for you in court. Usually a lawsuit is filed because the victim does not agree to the settlement amount which has been offered by the insurance company. Your insurance company will have a team of lawyers to defend this suit and will notify you if you need additional counsel.
