Question:

What is a CT scan and how can it help me in court?

Answer:

The CT scan, also known as the CAT scan, is a very important, noninvasive tool used in the medical field.  CT scans are used for medical imaging in addition to x-rays and medical ultrasonography.  CT scans are often essential for diagnosis as well as treating different medical conditions.

“CT” stands for computed tomography.  CT scans use tomography, which is created by computer processing.  The computer processing is used to create a 3-D image of the inside of some object (an organ for example).  The 3-D image is generated from several 2-D x-ray images, which are taken from the same point (axis of rotation).  CT scans generate a great deal of data that can be manipulated (windowing) into depicting a body structure/organ.

Since the CT scan is use in the medical field and deals with medical conditions it can also be used for a variety of reasons in the courtroom. The scan can provide evidence of disease, injury, infection, etc.  However, if the injured person happens to suffer from a mild brain injury (trauma to the brain, but only results in brief unconsciousness or none at all), CT scans may not be very helpful; these injuries are microscopic and may not show up on a CT scan.  When litigating this type of claim there are essentially 2 things needed to prove mild brain injury: the reality and severity of the injury.  You need to make this “invisible” injury a reality.  This is established through credibility and evidence.

It is important to consult with your attorney to ensure your rights are protected.  A skilled litigation attorney can discuss with you your strategy and the evidence rules.
