I am having difficulty getting a medical letter from my doctor in proceeding with my personal injury claim, what do I do?
I was involved in an accident that was held liable by the store it incurred in. I proceeded to file the personal injury claim on my own which has been going smooth so far. However, in order to finalize the settlement and ensure it will be paid by the liable pary's insurance company, I need a medical letter signed by my doctor stating that the surgery is need as a 100% result from the accident. However after talking to my doctor, he is claiming he can't do that and al though its more than likely its from the accident, the extent of the surgery could have been further accelerated from other known factors, as well as a prior known condition I had which is related. I know for sure this surgery is from the accident. What can I do?

Usually, Personal Injury Attorneys serve as your legal representation in matters such as obtaining the proper evidence needed to recieve compensation. They would be able to negotiate the settlement with the liable party, as well as expertly speak to your doctor in getting the appropriately worded letter. If you get the letter on your own without the counsel, it may be worded in such a way which will deny you proper compensation for your medical bills which I am sure you would not want to risk.
Furthermore, your doctor is probably feeling at risk considering this is a lawsuit and does not want to get too involved, or held liable for anything which may be deemed incorrect by the liable party's lawyer. If that does end up happening some how, both you and your doctor would get in further trouble as the claim would be appealed.
You should consult with a Personal Injury Attorney immediately. You can still do so even though you filed the claim originally on your own. It is not too late. Good luck.
