Usually, the city or municipality where the manhole cover is located is responsible for the maintenance and care of the manhole cover. There are usually laws in place that prevent lawsuits against the city government or municipality, unless there is negligence or premise liability claims made. These laws vary city to city, and state to state. You may be able to sue the city for negligence in maintaining an improperly closed manhole cover. As well, there may also be a claim involving premise liability because the city had a duty to keep the manhole cover properly maintained or at the very least post warnings about it. You should speak with an experienced personal injury lawyer who can assess your claim and determine whether or not you would be able to file a lawsuit to recover damages.
