I was injured on a rented jet ski from another jet ski. Who is at fault? The rental company or the other person?
Question: I rented a jet ski and was seriously injured when another person on a jet ski ran into me. He claims that the accident was my fault even though I have witnesses against him. Can I file a personal injury lawsuit against them or the jet ski rental company?

Jet skis are a very enjoyable form of entertainment and sport for many people during the summer months. Many people are under the misconception that Jet Ski riders themselves are responsible for causing the majority of accidents. In reality, there are a variety of things that can cause an accident. Jet ski accidents cause far greater injury than other boating incidents. It is imperative that Jet Ski operators have proper training and instruction and not to operate a personal watercraft while under the influence of drugs or alcohol. When another individual’s negligence causes a Jet Ski accident and someone is injured as a result, a personal injury suit can be filed to reclaim the cost of medical bills, lost wages and pain and suffering.
Depending on the location of the accident, a personal injury claim will be governed by both federal maritime and state law. These cases can be quite complicated and may involve product liability in regards to improper design, product malfunction, or failure of proper warning and potential danger in the use of the product.
Additionally, you may be able to file suit against the rental company if the personal watercraft was not maintained properly and this was a factor, which caused or contributed to the accident.
