My docture refused on performign a Cesarean section. 3 months after birth, my son is having serious problems. Is this a lawsuit?
About an hour before my son was born, a nurse told me he his heartbeat was poor and he was “in distress.” However, my local doctor decided against doing a Cesarean section. Three months have passed and I’m struggling to help my son cope with some rather serious physical problems and developmental delays. Who should I turn to?

Since your situation sounds a bit complicated, it would be wise for you to consult with a personal injury attorney who specializes in cases involving both “birth defects” and “fetal distress.” Women who have experienced labor complications like yours often rightfully expect to receive a Caesarean section -- it can shorten the duration of serious prenatal complications and make the baby ready to receive optimal care immediately.
Be sure to discuss with your lawyer if you requested a Caesarean and what your reactions were to various drugs administered throughout your labor and delivery. An attorney will also investigate the full range of care given to your child immediately following his birth.
There are reasons why a good doctor might not perform a Caesarean, so it’s important for your lawyer to fully investigate and review your past medical records to more fully understand your doctor’s choices. However, judges and courts are frequently sympathetic to plaintiffs forced to cope with struggles like yours.
