I work at a factory that handles a variety of toxic chemicals. I think I have developed some illnesses. Can I sue my employer?

I have worked at a factory that handles a variety of toxic materials, including benzene. I have been assured that the highest safety standards are in place by my employer. Recently, I have been diagnosed with anemia and have been told it is a common disease that comes from exposure to benzene damages. What type of legal recourse do I have?

As you may know, anemia is a decrease in the normal number of red blood cells (RBCs) or less than the normal quantity of hemoglobin in the blood. Benzene damages the bone marrow and can cause a decrease in red blood cells, leading to anemia.

It is the responsibility of employers operating facilities that work with benzene and benzene-laden materials to ensure the safety of their employees by taking measures to minimize exposure to prevent the onset of diseases such as anemia. Failure to take such measures is deemed negligent and grounds for legal action. Benzene lawsuits are designed to provide compensation for pain, suffering and legal expenses incurred as a result of an employer's negligence. Moving forward, please consult with an Environmental Lawyer to determine the best course of action for your case.
