Question:

I was admitted to the hospital with abdominal pains, and the doctor diagnosed me with heartburn and sent me off. 6 hours later, in the middle of the night I woke up with extreme pain and went back to the hospital. It turns out my appendix had ruptured and I had to have surgery.

Now, because of this, I have had to endure two other surgeries and have been in and out of the hospital for months. Is the doctor liable for malpractice?

Answer:

The initial misdiagnosis is certainly grounds for a medical negligence claim. The only question you will need to consider is the extent of your damages. Medical malpractice personal injury cases are usually very expensive to undertake, and if your injuries do not warrant a large enough settlement or award, it may not be worth the trouble.

That being said, you should always talk to a personal injury lawyer with experience in medical malpractice cases. You may be surprised to find out that your case is worth much more than you think. If it is not, you can get legal advice regarding your rights to compensation outside of the courts. An attorney may be able to get a reasonable settlement from the hospital without having to file a medical malpractice case in court.
