I’ve recently gave birth to a child who suffers from birth defects. One of my relative’s friends, a doctor, believes that it could have been prevented or at least diagnosed. What are my rights?

Sadly, birth defects can be tremendous heartbreak and financial burden on a family. Many birth defects can be the result of a doctor’s negligence in failing to diagnosis the problem, or a result of improper treatment. A doctor owes the patient, and fetus, a professional duty to act as a competent, well trained doctor in the field. When a doctor’s care fails to meet this standard, which may or may not be the case, you and your child would likely have a claim of medical malpractice and/or negligence against the doctor.
You should speak with an attorney experienced in medical negligence cases to fully assess your claim and ensure that you do not lose the right to sue because the time to do so has elapsed.
