In cases involving manganese exposure, courts may award past damages, such as lost wages, pain and suffering to date, and past damages such as health care costs. Mrs. Smith's brain damage children may also claim emotional distress damages, loss of benefits and economic opportunity, loss of enjoyment of life, as well as future medical care and other types of future damages. Punitive damages may also be available where the conduct was willful or knowing such that the defendant knew or should have known that the tenants would be placed in danger and failed to take precautionary measures and warn of the danger.
