Wrongful death lawyers are attorneys whose specialty is in wrongful death — the death of a human being due to the negligence, malice, or intent of another human being. Example of events in which wrongful death is commonly an issue include car accidents, workplace injuries, medical malpractice, and product liability. In any of these examples, although the victim is deceased, his or her family has the right to pursue damages in court. With the help of an attorney, a member of the family can sue the offender in court, not only for damages related to the death itself, but also for damages directly on the victim's behalf, called survival action. In order to receive either, however, the plaintiff must prove with a preponderance of evidence that the defendant caused death, was negligent or malicious, and that the family is suffering substantially as a result of the death.
