Trespass

Trespass is the action of accessing, without permission or invitation, onto another person's property. In civil law, there are several types of trespass, all of which qualify as torts. One of the most common types of trespass, called trespass to land, involves a person who enters another person's land without having permission or a valid legal excuse, such as being a salesman or census worker. Other than trespass to land, there is also trespass to chattels and trespass to person. Since each type of trespass qualifies as a tort, the victim of trespass can sue the offender, recovering damages for injuries or losses sustained as a result. In addition, victims may also sue in certain cases regardless of whether or not harm was done in order to receive punitive damages for the trespass.
