A traumatic brain injury lawyer is a lawyer who sues in lawsuits on the behalf of traumatic brain injury (TBI) victims. Lawsuits of this type involve the commonly known tort of personal injury – which means they take place in civil court, where the lawyer must prove the plaintiff's case by preponderance of evidence (more likely than not). In the case of TBIs, proving fault can often be difficult, which is why a specialty attorney is needed. TBIs most often are undiagnosed for a while after an incident, but that incident still often is the cause of the injury nonetheless. A TBI lawyer must be able to prove to a jury that, despite the late diagnosis, this injury was more likely than not the result of the defendant's actions. TBI lawyers frequently also must argue for high compensation claims, although the effects of TBI cannot be easily seen outwardly.
