A toxic tort lawsuit involves a personal injury that has been caused by some form of chemical exposure. In particular, a toxic tort is one committed by a manufacturer or other supplier whose product (or the process involved in creating the product) is the cause of injury. Toxic torts include a number of products that are prone to causing such exposure, including pharmaceutical drugs, pesticides, and asbestos in automobile manufacturing. In fact, asbestos exposure is one of the most significant issues surrounding the toxic tort — workers in certain industries are forced to work in conditions where asbestos, among other chemicals, results in disease and sometimes death. Similar to other torts, toxic torts involve negligence on the part of the defendant. If proved that the manufacture was negligent and caused injury, the plaintiff will receive compensatory damages for the injuries and/or illnesses that have been suffered, only it is generally difficult for toxic torts to be proved.
