Tort Reform

Tort reform is a system of proposed changes to civil law that are intended to lower the amount of litigation and damages in the justice system. In particular, the proposed changes would lower the amount personal injury victims, especially those of medical malpractice, could receive for their losses in court. A large element of enforcing lower damages would involve establishing damage caps — awards higher than the cap would not be allowable. In doing this, doctors would be placed at a much smaller risk for costly lawsuits, no longer needing to pay for very large insurance premiums to malpractice insurance companies. As a result, in theory only worthy cases would burden the court system with litigation. Quite possibly, the damage caps would also allow doctors to charge less, granted they do not need to pay for malpractice. However, many are unsupportive of tort reform and believe it will damage the justice system.
