Tort Lawyer

A tort lawyer is a lawyer who handles lawsuits in civil court, one if the most common being personal injury lawsuits. Other common subjects of lawsuits – which in civil court are known as torts, or civil wrongs – include trespass, assault, defamation, and product liability. A tort lawyer's job is very different than a criminal lawyer. Since tort lawyers work in civil court, they are taking action against or defending against another person, rather than defending against a government prosecutor, as would happen in a criminal case. Their responsibilities also change – instead of proving beyond all reasonable doubt, a tort lawyer for a person being sued must prove that it is "more likely than not" that their client is correct. In general, tort lawyers for plaintiffs will handle cases on a contingency basis (meaning they receive a percentage of the award), whereas defense lawyers will require a flat fee or retainer.
