When an injury occurs during athletic activity, it is termed a sports injury. Sports injuries can range from broken bones & fractures to head trauma and even death, as long as they took place while the defendant was engaged in sports play. In many of these injuries, however, the injured may find it difficult placing liability on someone else. This is the result of two legal elements – assumption of risk and waiver of liability. The first means that an athlete assumed the risk of injury by engaging in the sport, and the second means that the athlete signed away liability claims with a waiver. Nonetheless, a sport injury lawyer may still be able to prove another person's liability, if there was negligence that reaches the level of gross negligence or that overrides the waiver. For example, if another player maliciously fouled the victim causing the injury, it can be considered gross negligence and that person may be held liable.
