Product Liability Recall

Every year in the US numerous product liability recalls are issued by manufacturers. These product recalls occur when new evidence comes to light which indicates that one of their products may present a danger to consumers. It is not possible for a manufacturer to remove liability for the possible consequences of using the product simply by issuing a product recall, as there is always the possibility that some consumers will not be aware of the recall occurring. In many instances, even when a manufacturer wishes to recall a product, they may not be able to locate all the users or purchasers of that particular product. There are certain product recalls which receive wide-spread news coverage, but many do not, which means that there may be significant numbers of consumers who continue to use potentially dangerous products which have been recalled by manufacturers. This is further compounded by the fact that consumers themselves bear no legal responsibility for familiarizing themselves with lists of dangerous products and recalls. This then leaves the product manufacturer open to product liability lawsuits even where a recall has been initiated.
