Product Liability Litigation

Product liability litigation often involves proving that a product is either defective or has a defect. Victims of injury from a product often don't realize that the term ムdefective' has a broader meaning than they might anticipate. The law considers any product which is unreasonably dangerous for its intended use to be considered defective. The key term here being ムunreasonably'. The product may have inherently dangerous characteristics but would not be considered unreasonable. Gasoline is a perfect example. It has inherently dangerous characteristics, but it is not considered unreasonably dangerous and no lawsuit could be won if someone were injured by drinking it, assuming they knew it was gasoline. There are also distinctions made between manufacturing defects and design defects. A manufacturing defect is a defect that occurs when the final product does not meet the plans or specifications provided by the manufacturer. A design defect occurs when the product is manufactured completely to specification but the design itself has flaws that make the product defective. Evaluating a claim for product liability litigation involves weighing whether or not an inherent danger makes the product unreasonably dangerous for its intended use and whether or not there were adequate warnings of misuse.
