Premise Liability

Premise liability is a legal theory making the owner and/or occupiers of property liable for harm that takes place on their property. This liability applies not only to business operations, such as recreational centers, it also applies to residential property. The law is primarily meant to protect visitors from harm whilst on another's property. According to the theory of premises liability, the owner or occupant of premises has a duty to those who enter their premises to ensure their safety. Therefore, an injury resulting out of any unsafe conditions can be seen as negligent, and the injured can sue for damages. Per state, however, the laws regarding premises liability can differ widely. In different states, the owner of premises may have varying amounts of liability based on certain factors, especially whether the injured was an invitee, licensee, or trespasser.
