The deposition is one of the most essential steps in a personal injury lawsuit — it can also be one of the most troublesome and scary to the plaintiff. In a personal injury deposition, a lawyer will interrogate someone who is involved in the incident, often times the plaintiff himself. During the deposition, the lawyer will depose the plaintiff, asking questions relevant to the case that may be important in proving certain things. Depending on the choice of the two parties, the deposition may either be transcribed by machine, videotape, recorded, or hand written. The deposition is formal, and as such there are several important things to be heeded by the plaintiff — dress formally, answer only what is asked, bring a lawyer, and think before answering questions.
