Lead Paint Lawsuits

Lead paint is recognized as posing a serious health hazard, particularly to children who may suffer from developmental disorders when exposed over a prolonged time to lead. Several lead paint lawsuits have been mounted in recent years against large manufacturers of lead paint who were believed to have been aware of the possible dangers associated with their product, but did not elaborate on this in their marketing or product labels. Lead paint was banned from use in residential property in 1978, but remains a significant risk in any house which was built before this time. The Lead-Based Paint Disclosure Regulation which was enacted in 1996 now calls for property owners to disclose to potential buyers and tenants the amount of lead paint present in the property. Lead paint lawsuits may also be mounted against any party who fails to do so, where illness results from lead paint exposure.
