Lead Paint Ban

The United States government issued a lead paint ban through the Consumer Product Safety Commission in 1978 (16 Code of Federal Regulations CFR 1303). This lead paint ban was enacted as research came to light which showed that long-term exposure to lead could be very dangerous to human health. This is particularly true for young children and pregnant women, as lead exposure may lead to physical and developmental defects, including growth retardation and lowered IQ. According to this legislation, any paint which contains more than 600ppm or is 0.06% comprised of lead is considered to be lead paint and is banned for use in residential premises. This lead paint ban effectively means that no house constructed since 1978 should contain lead-based paint. As an extension of this legislation, the Lead-Based Paint Disclosure Regulation was also enacted in 1996. This states that owners of houses built before 1978 must disclose the presence of lead paint to potential buyers or tenants.
