Landlord Tenant Disputes

The relationship between a landlord and tenant can easily be overwhelming, to one or to both parties, which is why landlord tenant disputes are common. Now, while there is no law requiring a landlord and tenant get along with each another, there is distinct legal rule regarding the duties of landlord and tenant. To begin with, both tenants and landlords have rights granted by law – the tenant has the right to rent without discrimination, live in safe and habitable premises, and the right to privacy; landlords have the right to screen tenants, to use a security deposit, and to enter the home with reasonable notice. More importantly, since the two are involved in a rent/lease arrangement, there is a contractual agreement governing their relationship. For example, a contract may state that a tenant must routinely maintain or that the tenant must pay on a certain day each month. If there is a violation either of the contract or rights, there is justification for a lawsuit to be filed in housing court.
