Gross Negligence

Gross negligence is a form of negligence where the offender has been "more" negligent than what can be considered reasonable. The separation between an act of ordinary negligence and one of gross negligence is that gross negligence specifically shows that the offender was not mindful of the injury that could be anticipated to result. The offender is negligent to a point beyond simple recklessness, in that another life is carelessly placed in danger, which makes it a more serious offense in court. To determine gross negligence, courts generally follow the standard of a reasonable person. If the actions of negligence exceed the negligence a reasonable person could commit, it then becomes grossly negligent. In court, actions that constitute gross negligence often frowned upon in making determinations of fault and punishment. For example, injuries taking place in the presence of a waiver may still be punishable if gross negligence was involved.
