Criminal Negligence

Criminal negligence is a form of negligence that shows higher severity than the standard of negligence. In general, negligence is the failure of a person to operate with care and uphold their duty to whomever it is owed. When that duty goes unfulfilled through the person's actions, it is considered negligence, and it becomes a legal concern once the negligence has caused injury or poses risk of injury. In the case of criminal negligence, the risk posed by the person's negligence is so great that it is unreasonable for it not to have been foreseen. Determining criminal negligence is based on reasonable person standard — if the risk posed by the negligence would have been foreseen by a reasonable person, the negligence constitutes criminal negligence. Synonymous to negligent manslaughter, criminal negligence that occurs with homicide is a felony and will require that the offender serve jail time.
