Cerebral Palsy Law

Cerebral palsy is a condition that makes the body unable to control muscles. This condition is due to damage to one or more parts of the brain and is usually incurred during fetal development, during birth or shortly after birth. If caused during birth or shortly after birth, the cerebral palsy may have been preventable and someone should be held responsible. Cerebral Palsy law seeks to have compensation awarded in the cases that are preventable, those that are due to birth injuries. Monetary compensation cannot fix the damage done to the child. They will still have a life filled with mental retardation, an inability to control their own body, impairment of sight, hearing or speech, and seizures. What monetary compensation can do for these children is provide them with the care necessary to make their life comfortable and as full as possible. This includes doctors, therapists, nurses, educators, and social workers; medical equipment, medications and surgery will also be needed. The costs of care will continue to increase as the child ages, another factor that has to be taken into account with litigating a cerebral palsy law case. Cerebral Palsy law can't negate the fact that the child has suffered a tremendous injury, but it can lessen the financial burden on the family.
