Car Crash

If a car crash only involves one person, or absolutely no damages are sustained, it can usually be settled without a problem. Unfortunately, that is often not the case. When car accidents involve multiple drivers and/or there are damages and injuries, there can easily be cause for concern and dispute. In many cases, the dispute is concerning with whom the blame should be, and if that person should pay damages. Essentially, in these accidents, known as personal injury cases, there are three elements that must be proved – fault, negligence, and damages. If there are damages, the person(s) determined to be at fault will be responsible for damages to the other driver(s), payable by their insurance if they have coverage. In the event that no agreement may be reached out-of-court, a car crash may be taken to trial where it will be the court's responsibility to determine fault, negligence, and damages.
