Brain Injury Law

Brain injury law varies from state to state. As such there are no universal laws that govern the court in regard to brain injury litigation. There is, however, a common denominator that all states recognize in regards to brain injury law, and that is that in order to hold a defendant, whether an individual or some other entity, responsible and liable for a brain injury suffered by a plaintiff, there must be some form of neglect present, whether intentional or not. This negligence can be anything from a bicyclist who suffers a brain injury as a result of a motorist who disobeyed traffic laws, and as a result hit and harmed the cyclist, to a medical establishment that failed to take precautions when moving a patient, and dropped them on the floor causing the brain injury.
