Battery

Although the terms "assault and battery" are often grouped as such, they are in fact two separate legal concepts. They are grouped due to the fact that when battery takes place, it almost always happens after an assault. Whereas assault is an action of threatening or attempting injury, battery is the carrying out of the harmful action. In order for battery to have taken place, the actions of the accused should have fulfilled certain criteria. Firstly, intent, and secondly, wrongdoing, meaning the person should have purposely taken the action with plans to cause harm. Battery can occur in a number of situations: domestic violence and public fights are common examples. Civil battery is another type of battery that does not require intent of wrongdoing — a person can be guilty of this type as long as they have initiated with another person without consent. Aggravated battery is synonymous with regular criminal battery except a weapon has been introduced into the situation.
