Accident Injury Settlements

In the case of any accident, victims who receive injuries may be entitled to compensation if another party was responsible for causing the accident. This usually forms a "personal injury claim" or a "personal injury compensation case" where a lawyer is chosen to represent the victim and prove the negligence of the person causing the accident. Many of these cases never go to court, but instead the two parties involved reach an agreement with the help of their lawyers. This usually occurs when the party at fault offers the victim a certain amount of money, in return for which the ability to sue is forfeited and the case does not proceed to court. The amount of money which is offered and accepted is termed the "settlement". Most accident injury settlements are less than may be achieved by pursuing the case through the courts. There is however a risk when turning down any settlement that the judge or jury who hears the case may not award in favor of the victim, in which case they would then receive no compensation, and may be left with significant legal expenses.
