Product Liability

Product liability refers to the legal responsibility of manufacturers, distributors and retailers when they put a defective item on the market which harms a consumer. A product liability claim can be brought by an injured consumer or his or her survivors if the product caused a fatality. Often, product liability claims are brought because of a manufacturing defect, a design flaw or a failure to warn consumers of potential dangers. In many states, there is no need to prove that the defendant was negligent. The U.S. Consumer Protection Safety Commission warns consumers about defective products once a problem has been detected. While any defective product may lead to a product liability claim, defective toys and children's products often lead to product liability lawsuits.
