Lead Paint Law

Lead poisoning has been shown to cause severe health issues in children, which lead the U.S. government to pass laws making it mandatory for individuals to receive information concerning homes built prior to 1978. According to these laws, all sellers and landlords much disclose to potential buyers any known lead-based paint or lead-based paint hazards that the home might have. They must also give buyers or renters a pamphlet developed y the EPA, HUD and the Consumer Product Safety Commission that explains lead and the health risks associated with it. Sellers or renters who are renovating the home being considered must disclose this information and give the potential home owner the same lead information pamphlet. Homeowners have a ten-day period in which they can have the home inspected for lead based-paint and a risk assessment. The law does not require the seller to pay for this. Sellers or renters are not required to test for lead based paint, nor are they required to remove lead-based paint. The lead-based paint law does not invalidate any sales or lease contract. There are some situations that are not covered by the lead paint law. Efficiencies, dormitories, lofts, and units without bedrooms in them are exempt from the law. Also exempt are leases that are for 100 days, such as vacations or short term rentals and housing for the elderly or handicapped that do not also house children.
