Lead Paint Cases

Lead paint was banned from use in residential homes in 1978, but was commonly used prior to that, and is still present in most houses built before that time. The ban resulted from evidence that even small amounts of exposure to lead paint could cause severe health problems in children. In the last few years there have been several lead paint cases which have made it to court, with mixed results. These lead paint cases mostly involve families where lead paint was ingested as a child, leading to intellectual development problems from lead poisoning. There have also been a number of lead paint cases involving landlords who have failed to disclose the presence of lead paint in a house to tenants. These cases claim those landlords to be negligent and therefore liable for the ill health suffered by children living in those houses.
