Defective Products Liability

Defective product liability refers to any incident in which manufacturers fail to fulfill their responsibility to make sure the products they sell to the public are safe. In the U.S. there are three different types of defective products liability: manufacturing defects (faults in the manufacturing process), design defects (the product isn't designed to be safe) and a failure to warn (certain risks associated with the product are not made clear). Should any of these problems occur then the safety of the product user may be put at risk, which could result in significant injury or death. If this happens, then the victim may be able to mount a lawsuit against the manufacturer to show how their negligence caused the injury. This most often results in compensation being paid to the victim if negligence is proven, and may also impact the operations and sales of the company. In some cases, such as in drug manufacture, defective products liability cases may lead to bans on certain products being sold or used if they are assessed to pose a continued risk to the general consumer.
